PREFACE TO VOLUME EIGHTThis issue of the Harvard Legal Commentarymarks the culmination of the eighth season of the LawSchool´s Second-Year Writing Program. It is the hopeof the editors that it will provide both stimulatingreading and scholastic insight in a number of differentareas of the law.The primary goals of the Writing Program areto afford a means by which the second year student maygain experience in intensive legal writing accompaniedby faculty and student editing, and to provide a mediumfor the development and expression of his thoughts onany area of the law that interests him. As always, theProgram is open to all second year students on a volun-tary basis, and succeeds wholly in proportion to theirinterest, self-discipline and hard work.The Program this year has differed from thatof years past in two respects. The workload has beenspread out over two semesters rather than one, and inthe stages before the writing of the Comments reproducedhere greater emphasis has been placed on rewriting andreworking the written product.Otherwise the Program has retained its tra-ditional format. The editors consist of third yearstudents who either participated in the prior year´sProgram themselves or are members of the Harvard LawReview. These editors read and edit the several shortpapers prepared by each participant as well as the finalComment, which is also read by a faculty member andcross-edited by fellow participants. The editors inaddition provide the participants with a wide range ofrecent cases and topics from which to select their papertopics, and are responsible for publishing the HarvardLegal Commentary.We wish gratefully to acknowledge the assis-tance of Professor Frank E.A. Sander, the Program´sadviser, Gerda Andersen, our faithful secretary, andthe Faculty of Harvard Law School.
